On 19 July 2016, the European Commission published the imposition of a fine of 2.930 billion euros for major truck manufacturers, due to their operation of a cartel for 14 years, the purpose of which was to make money at the expense of truck drivers.

This is due to the fact that from 1997 to 2011, they had an agreement to increase the selling price of trucks over 6 tonnes and to delay the introduction of technologies related to emissions required by the EURO III to EURO VI standards, thus making a much higher profit from their sales at the expense of the truck buyers.

Who are responsible?

Those responsible for the illegal practice, selling nine of each ten trucks in Europe, marketing the DAF, Mercedes, Renault, Iveco, Volvo, MAN and Scania brands.

Who has been affected by this illegal practice?

Any individual or legal entity that purchased medium-duty trucks (between 6 and 16 tonnes) or heavy-duty trucks (more than 16 tonnes) between 1997 and 2011 can claim the premium they paid as a result of the cartel.

What sum can be claimed?

The premium is to be calculated on a case-by-case basis as this depends on the truck model, but prudential calculations put it at about 10% of the purchase price; therefore, about 10% of the price paid for each truck greater than 6 tonnes between 1997 and 2011 could be claimed.

What documentation do I need to do to make a claim?

Anyone who wishes to initiate a claim will have to collect at least the following documentation: Purchase Invoice of the vehicle in case of sale or lease contract in the event of leasing along with the payment supporting documentation. Driver’s licence and technical specifications for the vehicle. Transport licence.
